Agreement to Terms

By accessing or using TopoStory ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service. These Terms apply to all visitors, users, and others who access or use the Service.

Description of Service

TopoStory is a web-based application that enables users to create customized topographical maps from GPS track files (GPX). The Service includes features such as terrain contour generation, style customization, AI-powered point of interest discovery, and map export functionality.

Account Registration

To access certain features of the Service, you must register for an account. When you register, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized access to your account

Free and Pro Plans

Free Plan

The free plan allows you to create and preview maps with limited export capabilities. Free users may export a limited number of maps per month as specified on our pricing page.

Pro Plan

The Pro plan is a paid subscription that provides unlimited map exports and access to premium features. Subscription fees are billed monthly or annually as selected at the time of purchase. You can cancel your Pro subscription at any time, and you will retain access until the end of your current billing period.

Payments and Refunds

For paid subscriptions:

  • All fees are in Euros (EUR) unless otherwise stated
  • Payments are processed securely through our payment provider
  • Subscriptions automatically renew unless cancelled before the renewal date
  • We offer a 14-day refund policy for Pro subscriptions - contact us if you're not satisfied
  • Refunds are processed to the original payment method

Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Infringe upon the rights of others, including intellectual property rights
  • Upload malicious content, viruses, or harmful code
  • Attempt to gain unauthorized access to the Service or related systems
  • Interfere with or disrupt the Service or servers
  • Use the Service for any commercial purpose without our express permission
  • Resell, redistribute, or sublicense the Service
  • Automate access to the Service in a manner that exceeds reasonable use

Your Content

You retain ownership of the GPX files and data you upload to the Service ("Your Content"). By uploading content, you grant us a limited license to:

  • Process and display Your Content to provide the Service
  • Store Your Content on our servers
  • Create derivative works (the maps you generate) based on Your Content

You are responsible for ensuring you have the right to upload and use any content you submit. The maps you create using the Service are yours to use, share, and print.

Intellectual Property

The Service and its original content (excluding Your Content), features, and functionality are owned by TopoStory and are protected by international copyright, trademark, and other intellectual property laws. Our trademarks may not be used without our prior written consent.

Maps generated through the Service include data from third-party sources including OpenStreetMap contributors. When sharing or publishing your maps, you should include appropriate attribution as required by the respective data licenses.

Third-Party Services

The Service integrates with third-party services including OpenStreetMap for geographic data and Google Gemini for AI features. Your use of these integrated features is also subject to the respective terms of service and privacy policies of those third parties. We are not responsible for the content, policies, or practices of third-party services.

Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to provide advance notice of planned downtime.

Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be error-free, secure, or uninterrupted. Maps generated by the Service are for personal use and should not be relied upon for navigation in hazardous conditions. Always carry appropriate navigational tools when hiking or exploring trails.

Limitation of Liability

To the maximum extent permitted by law, TopoStory shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the Service. Our total liability shall not exceed the amount you paid to us in the twelve months preceding the claim.

Indemnification

You agree to indemnify and hold harmless TopoStory and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the Service will cease immediately. You may delete your account at any time through your account settings or by contacting us.

Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of Ireland, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Ireland.
